MEMBERSHIP POLICY

OF

FOUR RIVERS SPORTSMAN’S CLUB, INC.


This Membership Policy (this “Policy”) of Four Rivers Sportsman’s Club, Inc., a Nebraska nonprofit corporation (the “Club”), dated effective upon its authorization, approval, and adoption by the board of directors of the Club (the “Board”), sets forth certain rules, regulations, and terms of membership that each member of the Club (each, a “Member” and, collectively, the “Members”) agrees to be bound by and agrees to abide by as a condition to membership in the Club.


  1. Safety and Club Rules. Each Member, on his/her own behalf and on behalf of his/her respective friends, family members, employees, contractors, invitees, licensees, agents, and other guests to the premises of the Club, agrees to abide by all of the rules and procedures of the Club related to safety, whether such rules and procedures are set forth in the governing documents of the Club (including in the Bylaws of the Club), in this Policy, or in any document or posting on the premises of the Club, or as may be provided orally by any director, officer, manager, employee, or authorized agent of the Club, and acknowledges and agrees that the physical presence of any person on the premises of the Club is subject to such person’s continuous strict adherence to such rules and procedures.
  2. Club Communications. The Members shall have the right to opt out of marketing communications from the Club, however, certain communications from the Club, including, but not limited to, communications concerning club operations, dues collection, amendments to the Bylaws of the Club, and areas of safety, may not be so opted out of by the Members.
  3. Privacy Policy. The Club respects the privacy of the Members and is committed to protecting their personal information.

a. Membership data, including, but not necessarily limited to, names, addresses, contact information, payment information, payment history, membership status, and reason for membership termination may be collected by the Club for the purpose of managing memberships, communicating with the Members, collecting membership dues, and organizing the Club’s activities.


b. Each Member, on his/her behalf and on behalf of his/her respective friends, family members, employees, contractors, invitees, licensees, agents, and other guests to the premises of the Club, consents to the storing of their data in the US and authorizes the Club’s then current third-party membership management platform (such platform being ClubExpress as of the effective date of this Policy) to send transactional messages (e.g., membership renewal notices and payment confirmations) on behalf of the Club and consents to receive all such messages.


c. The Club will not disclose any Member’s personal information to third parties without the consent of such Member, except as may be required by applicable law, rule, or regulation.


d. The Club will not sell any Member’s personal information or membership related information.


4. Acknowledgment; Assumption of Risk. Each Member recognizes and acknowledges that his/her presence upon the premises of the Club, along with the presence of his/her respective friends, family members, employees, contractors, invitees, licensees, agents, and other guests, is inherently dangerous and presents various risks, including, but not limited to, risk of death, physical injury, and loss of property. Without limiting the foregoing, such risks may relate to arise from the following: hazardous surface conditions; exposure to the discharging of firearms; various terrain and other obstacles, man-made or natural, whether they are obvious or not; acts or omissions of other persons on the premises; and heavy machinery. Each Member hereby agrees to assume full responsibility for the full risk of any injuries, including death, damages, or loss which such Member, or such Member’s respective friends, family members, employees, contractors, invitees, licensees, agents, and other guests, may sustain as a result of participating, in any manner, in any and all activities whatsoever connected with, associated with, or arising out of the presence of any such persons upon the premises of the Club.


5. Release; Waiver of Liability. Each Member, on his/her behalf and on behalf of his/her respective friends, family members, employees, contractors, invitees, licensees, agents, and other guests to the premises of the Club (collectively, the “Releasors”), hereby releases the Club and its, directors, officers, managers, employees, contractors, affiliates, agents and all persons acting by, through, under or in concert with the Club, past or present (collectively, the “Releasees”), from any and all claims (including, without limitation, third-party claims) for any injury, temporary or permanent disability, death, damages, liabilities, costs, losses of property, penalties, expenses and/or causes of action (collectively, “Damages”), now known or hereafter known in any jurisdiction in the world, arising out of, attributable to or relating in any manner to the Releasors’ presence or activities upon the premises, whether caused by the negligence of the Club or any of the Releasees or by any other reason. The Members recognize and acknowledge that this Section 5 of this Policy is intended to be, and is, a complete release, as much as allowed by law, of any responsibility of any of the Club or any of the Releasees for any and all Damages directly or indirectly incurred or sustained by the Releasors while present upon or engaging in activities upon the Club premises.


6. Indemnification; Covenant Not to Sue. Each Member hereby agrees to indemnify, defend, and hold harmless the Releasees from any litigation expense, attorney fees, or claim for property damage or personal injury in connection with the Releasors’ presence upon or use of the Club premises. Each Member further covenants not to commence or prosecute any action, suit, or other proceeding against the Club or any Releasee as a result of any Damages directly or indirectly arising from or relating to the Releasors’ presence or activities upon the premises or any acts, omissions, or negligence of the Releasors.


7. Binding Effect; Severability; Amendments and Modifications. This Policy shall be binding upon the Members and construed and governed in accordance with the laws of the State of Nebraska. If any portion of this Policy is held invalid or unenforceable for any reason, the remaining portions shall continue to be valid and enforceable. This Policy may be amended or modified from time to time by the Board as the Board deems appropriate and in the best interest of the Club; provided that any such amendments or modifications to this Policy shall relate to the subject matter presently referenced herein.
